i understand where you’re coming from, and i read the previous posts by the people who got banned. and i’m pretty sure, as far as i can remember, that one of them was only asking why the emulator was giving him an error (which is, from your instructions, a legal kinda thing to post here). it’s just one of my random thoughts during the day; don’t want to get banned.

Those fellas who were banned didn’t direct, or help anyone on how to obtain roms. I dont know them from jump, but I know enough where a mod screwed up, do to one reason or another.
Yep, and this is where you mess up. ROMs aren’t illegal in ithemselves. It’s the act of having a rom in your possession, without owning the actual game (cart, CD, chipset/board, whatever), that’s illegal. You have no clue on what that status is with the ones who were suddenly banned. They were banned without question, for asking how to get their emulators running, and working properly.
Quick facts.
-Emulators arent illegal. There’s no questions, or discussions for it. It;s been disucssed in court, and legal cases. As I sad, it’s owning roms (which are backups) without not actually owning legal copies of the games.
-CPS3 Emulation was made possible, so that the very hard, and delicate CPS3 boards can be backed up. A slew of arcade cabinets have hardware issues, or have had problems. Now, they can back them up, and run them still within cabinets, because they can now run them through these WIP emus.

let me tell you something. you do NOT know how the law is. all that BS that you hear about how its legal to have a copy if you own the original is a bunch of bullshit to me. for one, with a rom, the product has been altered(in this case cps3), you are acting upon copyright infringement. cps3 emulation was possible due to modification and circumventing the security to hack thru and make it work. that is automatically illegal. the fact that its modified constitutes it as a hacked rom. unhacked roms, once again, touchy subject. but we choose not to bother with it and leave it alone for safety
next, yes its great that its hacked, yes its great that it may be possible to revive dead carts now. but in reality, that is ILLEGAL. ESPECIALLY if someone is selling the service to someone. this is illegal. do the companies care? dunno, some might, some might not, since its deemed a dead format. but that is not up to us to decide.
honestly, i didnt know the other users were banned. but it was justifiable. one of the guys said his 3s(which is illegal rom) wasnt working. one guy asked what the problem was, and the other guy said “i cant talk about it here, just send me a pm” that is a bannable offense. even says so in the rules. i even stated it earlier in the thread not to go there.
i think you base the law more on “will the companies that hold the copyright run with the ball and do something” rather than factual law. it is copyright infringement. and its not tolerated in anyway. thats all there is to it
How is one going to prove that they own the game to a rom? Break the disk and take a picture? Anyway as for owning rom and emulator, it is legal just as it is to have a mp3 on your computer if you have the actual cd. Otherwise I think Windows media player and other CD ripping programs would have multiply lawsuits for providing means to put cd music to the computer. By owning a rom, all you are doing is creating a copy on your computer just like a mp3 of a song.
Section 117 of the U.S.C. Title 17 (Copyright law), states:
Notwithstanding the provisions of section 106, it is not an infringement for the owner of a copy of a computer program to make or authorize the making of another copy or **adaptation **of that computer program provided:
(1) that such a new copy or **adaptation **is created as an essential step in the utilization of the computer program in conjunction with a machine and that it is used in no other manner, or
(2) that such new copy or adaptation is for archival purposes only and that all archival copies are destroyed in the event that continued possession of the computer program should cease to be rightful. Any exact copies prepared in accordance with the provisions of this section may be leased, sold, or otherwise transferred, along with the copy from which such copies were prepared, only as part of the lease, sale, or other transfer of all rights in the program. Adaptations so prepared may be transferred only with the authorization of the copyright owner."
Console games/arcade games are classified as computer programs.
So, according to the copyright law, you CAN own a copy of a software program you own(contrary to what Nintendo and the IDSA wants you to believe).
tl;dr: It is not illegal to have a rom or emulator.
We *aren’t *gonna agree, or come to conclusion on this without bumping heads, and since I have no jurisdiction here, I’m halting on any further discussion with you on this subject. So, on that note, it’s whatever.
As for future reference, Emulation talk of any kind should be disallowed, since, according to you fellas, it’s just about grounds for a ban, regardless of how cautious you are.
Until you guys make the grounds for these types of subjects understood perfectly clear, in a sticky perhaps, people are gonna get banned, thinking they were going about their business appropriately.
I suggest you guys read up on copyright laws, and how they work. These subjects seems extremely new to you (sabre, wiz).

well if you guys wanna avoid the worries of whats boarderline and getting infractions/deletions/bans, then you are more than welcome to take it elsewhere. once again, talking about emulation is fine. talking about the games, fine. talking about making it work and obtaining, is NOT. i honestly dont see that to be a very hard rule to follow.

It STATES that you NEED TO OWN A LEGIT COPY in order to emulate it (aka, you need to own one, as long as a copy of it is in your possession), just as Wiz said. Contributing to unlawful activity is just as bad as doing it yourself. I’m all about emulation, all about mod-chips, free games, getting shit for free, because the guys that matter (developers) don’t get much money for it anyway, so I’d rather not cater to retail America, and getting stuff in general for free… But a rule’s a rule, if the owner doesn’t want the conversation here, leave it out. It’s really not illegal to discuss it, but the problem is, if somebody gets caught, and is asked “Where’d you get it?”, and that person points to SRK, guess what? WIz is responsible.
mixah, yeah i get what you’re saying. i grew up on street fighter, and jeesus, i was about to pay for premium myself too (my parents would have killed me, no joke). i check this place out at least twice a day, ever since my friend introduced me to it. i totally understand how this whole thing just blew up after one little mess up. i guess, it’s just the constant reminders of what we should do and what we shouldn’t do that got everyone riled up.
in the end, i’d hate for this place to go down because i’m stuck in school (for nearly the whole damn summer) away from home with absolutely nothing to do during my freetime. this place is my sanctuary from all the piece of crap school work i have to do. what started as a major WOOHOO EXCITEMENT thread has turned into a bloodbath. i’d like for it to go back to that.

so apparently i may be behind the times on the law i admit. even tho half that shit dont make sense and as usual, open to interpretation and loopholes. but even so. like wizard said, its a lengthy process to prove that the user has a legitimate original. and im very sure about 98% of the users(98 is a very generous number) on srk, do not own a cps3 board. granted its all assumption. but when you bring this stuff onto the site. you put the owner of the site at risk, in this case wizard. and it should be respected.
