Just so you guys know, speeding in itself is not a crime. A crime requires an injured party or property damage. Why do you think you go to civil court instead of criminal court?
ElderGOD: Thank you for bringing this up. It’s certainly an interesting topic, and how it gets handled in that San Antonio school will probably set precedent for similar incidents later on; I can only hope more people will take the same stand against it that the Hernandez family has.
However, I did want to take one choice quote from the article you linked: “Hernandez claims that teachers are, in some cases, requiring use of the badge to use the bathroom.”
If that’s true, I hope the teachers realize just how stupid that is, because it’s liable to backfire on them very, very badly. You can delay a student, but sooner or later they will ‘go.’ If they have an independent streak, they’re going to ignore the rule and head to a bathroom anyway because they value hygiene over misguided authority. That’s actually the best possible outcome in this situation. The worst outcome is if the student feels trapped between a biological need and a rule, and just… ‘goes’ in the middle of class. That sure as hell will interrupt the lesson at hand, and you can have fun explaining it to the parents!

A child who is actually an 18+ year old actor. So yeah, there’s really no “injured party” there, so not a crime by your definition.
crime = breaking the law and being subject to potential punishment by authority
rape = crime
speeding = crime
speeding to rape you = crime
speeding to rape you in a truly failed state = not a crime (but still a pretty heinous act)

I don’t like that site left out one important element, but I can’t remember what it is at this time. Anyway, speeding is not a crime because they can’t prove intent. Coming to a little girl’s house to fuck is a crime because they can prove intent and conduct.
The 18 year old actor is used to prove intent and conduct. If speeding is a crime, why can you get off by paying the court a fine when you’re guilty? There’s no fine to pay when you murder someone. And no bond is not the fine you pay. And if I’m misinformed, what makes what you say right? Please don’t say experience or your understanding. Because I’m learning how the justice system is fucked up by reading Black’s Law dictionary and the actual laws in my spare time.
