It’s not flawed, and I never said buying a used game is wrong. If I buy kingdom hearts new, and complete the game, and then sell it to you, Disney Interactive or whoever makes the game, is harmed JUST as much as if you were just to buy it used. That’s my point. Re-read the post.
Yeah, that’s kinda how the ENTIRE rest of the economy works. Everything else I buy, I get to sell if I really give a shit, more or less. Sure, you get some obvious exceptions (no, I can’t sell used needles unfortunately), but I can resell my couch, computer, books, tables, clothes, bed, hell even the Xbox itself. Yet you’re now telling me that the video games…oh no, they’re exempt. Why again? Explain why. You’re losing money. Yup, so does EEEEVERYBODY else. Yet again, this is how the economy works. You think the couch makers of the world aren’t really pissed that people are tossing couches on the curb for young students to pick up, rather than buy a new couch? Them’s the simple fucking breaks. You wanna know what killed this whole thing for me? I bought Ultimate Mortal Kombat 3 for XBLA. And then my 360 went up in flames. And Midway is gone, so therefore Ultimate Mortal Kombat is gone. So I can’t redownload a game I paid for and own.
Companies want to go to completely digital copies of games that will be so locked down you’ll only be able to play it on one device ever without ever being able to reconfigure your hardware in any way while this is on there. Because of idiot bullshit EULA’s and corporate studity and a complete lack of understanding of what their ACTUAL audience is. It’s movies you buy with “Don’t Pirate” warnings all over the opening (which you mysteriously avoid with pirated movies), and it’s bullshit like DRM and anti-used games mentalities. Fuck right off, don’t start pissing off your customers because you’re greedy fucks and stupid ignorant fucks.

I realize the issue of comp. software is a bit more nuanced, and I dont know naything, but I am inclined to think that this another unfortunate case of lawyers gone wild, devising more ingenious loophole exemptions.

I have no problem with developers going after used game sales considering the Gamestop model. I mean i buy a game new and then trade back in the next day and I only get half of what i paid for it and then they turn around and sell it back for damn near the same price new. I think developers should get a cut of the sales to an extent.
But they aren’t harmed. Whether they or you slice it any way. You can’t say that they are harmed in a business sense (business ethics), because our current business models say this acceptable and ethical. The same business ethics that they use to justify their behavior also applies to them. Otherwise there would be a law against it. They the publishers aren’t harmed because they already got their value for one unit of product.
Isn’t it more unethical, in a business sense to dictate what one can and cannot do for the one unit they purchased?
Pirating a game is bad because the person who pirates the game benefits from it without supporting the studio. The same case can be made if someone buys a used game.
