Having had a gun pulled on me once I understand instinctively you want to try and diffuse the situation (by removing the gun from the equation). Its hard to ignore someone who is agitated and pointing a gun at you. He didn’t just draw it to ward them off for approaching him, but he held it out. So people are suppose to not cross his path or drive by him because he is telling everyone that its his spot and you can’t be there isn’t good enough. Taking his gun away was the only way to diffuse the situation without anyone getting hurt. Someone pointing a gun at you is a dangerous situation period. Its not like this guy had enough bullets to shoot everyone in the street so why didn’t he leave?
The only witnesses the defense could call were family members, because they sure couldn’t call any of the people standing there being held a gun point. That had fail written over it, but you gotta try and make your client not look like some angry, agitated, clown standing in the street holding everyone hostage.
