Legal age is usually 18 and the lowest I’ve seen is 16.
It is technically underage sex so she should get some kind of jail time regardless. Granted there is a good chance the boy in question is probably larger then her and could have every well been down for the whole thing…however she is the adult and should know better.
If it was a man and underage girl the reaction would be different.
Well according to Virginia, she did a class 1 misdemeanor. When you have consensual sex with someone who is 15-17 & the person is 18 years in older.
*Misdemeanors are crimes that are more serious than petty crimes but less serious than felony offenses. Misdemeanors are divided into Class 1, Class 2 and Class 3 misdemeanors with Class 1 misdemeanors being the most serious. These are also sometimes referred to as Class A misdemeanors, Class B misdemeanors and Class C misdemeanors.
Punishment for all misdemeanor offenses can include being jailed for no more than a year, a fine or both. Class 1 misdemeanors are defined as crimes that carry a maximum punishment of more than six months in jail. Any crime that calls for a sentence longer than one year is deemed a felony, and the offender is sent to state prison, rather than a county jail. Fines for Class 1 misdemeanors usually range from $1000-$2500.
For people convicted of a Class 1 misdemeanor who have no prior convictions, punishment is more likely to consist of probation and community service instead of incarceration. A person on probation remains free but must adhere to a set of rules and restrictions, sometimes including abstaining from alcohol, not associating with other criminals and submitting to random drug tests. Violating the terms of the probation can result in the offender having to serve the sentence associated with his crime. Community service requires that the offender perform a set number of hours performing various tasks that benefit the community as a whole. These must be documented by a credible agency to count toward completion of the sentence. The conviction is often expunged once the terms of probation and community service have been fulfilled. Probation and community service are often handed down as punishments to non-violent offenders.*
So it seems like she should have gone to jail for at least 6 months but since she has no prior convictions that im aware of could be the reason they gave the probation instead. They probably ended up paying the $1000-2500 fine which is more common then putting someone to jail.
If anything the whole plot for murder was probably to avoid the 15year old from being accomplice but even then i dont think its an actual crime to plot to kill someone. As long as you dont go through with the actual plan.
I fail to see the crime. When I was 8 all I wanted was an older woman and for this kid to get a fake red head with pale skin and hipster glasses all I can think is “You lucky bastard!”
Alright I want to dispel this argument once and for all. I can concede in admitting the male sex drive is a variable worth considering because generally speaking men (especially young males) are intoxicated by a inconsolable horniness. The enthusiastic proposition of sex from a woman particularly 1 who is attractive is essentially the equilvent of throwing pieces of stake at a starving wolf. However no matter how much the boys in question are up for sex it still doesn’t change the fact that these older women are taking advantage of them. I’d argue the uncontrollable sex drive young boys experience is essentially a form of mental impairment in that it clouds and distorts their judgment and reasoning…it’s like giving crack to a crackhead.
For this reason we should not take female rapist lightly nor excuse their behaviour by pretending it isn’t a terrible crime. A rapist who takes advantage of their victim is still guilty regardless of the genders involved…so people have to stop making it sound like boys have it better because they might actually enjoy and want it. Most addicts would love to indulge in their vice…does this mean its acceptable?
This ad is rightfully being shitted on by people all over the net now…but I wonder how many people wouldn’t have mind if it wasn’t for the implied incest.
It’s 12 in Angola, 13 in Japan. By the law, sleeping with a 13 year old in Japan is more acceptable than a 15 year old in America. Laws shouldn’t be referenced as a standard during an ethical debate.
I skimmed to the thread.
Did anyone consider that she got a lighter sentence because she herself was a minor during most of it?
She stopped when she was 18.
Given the circumstances, I think the judge’s decision was fair. She was 16 when she started having sex with the boy and she stopped on her own. I’m not condoning her actions though because she took advantage of an 8 yr old.
Is saying that it’s sick and perverse for a 18 year old woman having sex with a 8 year old boy suddenly equate to some conspiracy theory. This sentencing also doesn’t exist in a vacuum because believe it or not it exist in a long standing tradition of female criminals getting lighter sentencing particularly when it pertains to raping underage boys. Would the judge have been as understanding if it was a 18 year old man having sex with a 8 year old girl?
Its amazing how quick people are when it comes to justifying and dismissing a crime so long as the victim is male…nice to know rape is only a 1 way street.
And to be fair, a large part of the dismissal does come from the victim bragging about it.
If you can find a story about an 16 year old guy raping a 8 year old girl, I would be very interested in reading it. Very interested.
