Selling used games may be illegal?

Check out this article: Gamasutra - News - Court Of Appeals Ruling Threatens Sale Of Used Games?

Now, I live in Canada, so while this news doesn’t affect me, if the US courts make it illegal to sell used games, there would be no stopping publishers from banning the sale of used games in other countries. This could also mean that you can’t sell older games such as those from legacy consoles.

Its a fight over the End User Liscence Agreement. It won’t be a big deal unless they start selling the games with the EULA in the game box and/or having you agree to it before you start playing. Fucking America, we legalese ourselves into heaving piles of shit.

i doubt this will pass as then where does it stop? Before you know it it would be illegal to sell used furniture.

even if it was illegal to sell used games, people would still sell them/buy them.

How about we make it illegal to sell content locked on the disc we already purchased? Nah, that’s anti-business and unpatriotic.

Yeah…you’d hear a faint cry of “Tsujimoto-sama…TAIHEN DAAAA!!!” from the east the moment that passes.

While slippery slope arguments are usually seem/are useless… since correlation=/=causation, because obviously the used car and game industry are different…

But if this does pass… what prevents others from making a similar argument and using this court ruling to help push their agenda?..

Yea, but sites like ebay and amazon would prohibit it therefore making it harder.

Just the same as trying to stop piracy. It isn’t going to happen ever.

this is a major battle that gaming companies are now waging, and while I see their POV, sadly I think they’re fighting a losing battle. We shall see how EA and THQ does after making used games unplayable online.

I said it before. If you want me to buy your games brand new, THEN SELL FOR LESS. Seriously 70 bucks for a shitty game that should have been released on Live or PS Store or whatever, is a fucking joke that nobody laughs at.

Seriously, I’ve rented so many games that are beaten and done in like a day or two, and you tell me that is worth full value (especially when you compare to games like Halo or CoD or virtually ANYTHING ELSE with replay value)??? Stop trying to maximize profit by fucking over valued customers.

And yes, the EULA needs to be fucking changed. That shit should NOT come up when u attempt to install/play a game, it should be signed before I even put money down. And the consumer should be allowed to modify the contract and resubmit it to the parent corporation, just like ANY OTHER LEGAL DOCUMENT THAT NEEDS TO BE SIGNED.

my take on this:

courts consider clickwrap/shrinkwrap that you click when you install software to be binding? it’s fucking clickwrap. it’s in the product that you already own.

and besides you own a fucking copy of the software ALONG with the license to use it. you have a disc with the software on it thus a copy and you are allowed to do as you please with the disc as it is your physical property. shit is like buying a car and saying you don’t own the car but just the title to it. The car can’t ask me to sign a fucking contract after I but it and drive it off the lot saying what I can’t and cannot do with it as it is already my property and I am free to use it as I see fit. If a fucking redneck wants to use his pickup truck as a kiddie pool, it’s completely within his right to do so. If I want to use

also, cracking content already on the disc should be legal too as it is already your personal property as it is contained on the disc. Cracking it is the same as breaking into a safe in your house that you lost the key to. Sure the company is allowed to sell access codes just like you can higher a professional safe cracker.

you coul always pirate, maybe then theyd see things aint all that bad.

Thats a retarded argument since their already fighting that shit to.

Reminds me of the time the RIAA guy said that ripping music from your own CD to your own computer constitutes theft.

Perhaps intellectual property isn’t as well-defined as physical property, but that doesn’t mean that one can be arbitrarily treated like the other.

might as well pirate, if i had a 360 none of my shit would be legal. but i own a ps3, and modding isnt available and that usb thingy doesnt work anymore, of topic, but i really wish wed be able to have emus on the ps3 or 360. thats where i give the old xbox real props.

they tried doing this yeeeears ago in japan and it didn’t stick

every individual country’s own laws would be a pretty big hindrance.

you should probably bother to actually read the licensing agreements since pretty much everything you said is specifically prohibited.

that would constitute EA and THQ making them unplayable. You have to pay MORE money on top of the used game’s price, in order to make it PLAYABLE.

More bullshit we have to deal with so they can continue to fuck the customer. Then they wonder why people pirate their software. Could it be because you’ve done your absolute best to bleed us dry from day one?

This is not gonna happen. Used games are like the gateway drug into gaming once you start playing those 5 dollar used titles at gamestop. It wont be long before your standing in line for 4 hours waiting on the next CoD forking over almost 70 bucks with the rest of us. puuhllleeeeez.
