Got caught going 24 over the limit

Be lucky that they got you going 24 over, and not 25 over. 25+ is reckless driving up here in MD/VA, and fines go up dramatically at that point.

The points you refer to are within the section of law for your state. Within the statute that you were stopped for, it will dictate the number of points assessed after your ticket is adjudicated. The points assessed do not impact your driving record until after you go to court and there is a disposition. So if your trial date isn’t for another month, there are no changes.

You cannot get rid of the points prior to the disposition of that ticket. These are your options:

Do not go to court - You will be found guilty, required pay the ticket fine with the assessed points on your license
Go to court and work something out with the officer and get a plea bargain and accept the new charges. At least if you go to court, you can testify and if he is not there, another officer in his/her place without any notes, or anyone to contest it, you may walk.
Hire a lawyer who will do the same thing in the previous line

Paying the fine is one thing, the points are what will impact your insurance. Most insurance companies begin to change your premium if the ticket is 10mph or greater. For example, in SC here is the sliding scale for the speeding section of law:

1-9mph - 2pts
10-24 - 4pts
25+ - 6 pts
A ticket “remains effective” on your drivers license for 3 yrs (as with most insurance companies). After 12 pts are assessed in that period, your DL is considered for suspension

Taking the 4pt reduction classes that you see will reduce the points, but will not really help your insurance policy post ticket. The 4pts just save you in case you get another ticket. The “defensive driver” discount is not really going to offset the high risk flag that you will have due to having a charge like that on your driving record

To say you did 24 over and the ticket is $169, that cop cut you a break. Look to see what the section of law was that he stopped you for. In SC I was stopped once for doing 11 over. I was cited for careless driving, a 2pt violation and a $70 ticket. Speeding would have been a 4pt and about $200

That would be “being responsible”, something not many young americans know about, apparently. Look at the housing mess: fools taking out oppressive loans on equity so they can have some extra cash to go crazy with, then blaming the banks instead of their own greedy selves.

Next to no traffic on the street…and some dumb fuck totaled his car by crashing into someone’s car. And the second car was over a block away when it finally came to a stop.

Most people speed at some point. You have to look at the laws where your from. I got caught going 80 in a 65, shit was dumb on my part. I got a fine mostly court fees and it was marked down to a non moving violation. No points no insurance increase, just 250 bucks out of my pockets. Wasnt worth it.

Who the hell said if it’s my first points, I shouldn’t worry? Shit is like 3 pts or my license may be taken away since I was 24 over the speed limit. I keep my eyes on the speed limit like i just found gold now. No more speeding for me!!

  1. If I signed “I plead not guilty and demand a court trial”, will I have to pay any fee to go to court? Or will they just tell me a date and I go and plead I’m not guilty?

  2. How many people will be in court? I tend to get nervous if there are too many people.

  3. How much will the insurance go up? I did say it was not my car, it was my friend’s car…So will my insurance or my friend’s go up?

4.Before I plead my trial, do I get a minute with the officer to work something out or what?

You could go to driving school and see if you can remove the points that way, but personally I wouldn’t even bother.

OP paying for a lawyer now heavily outweighs working off those points for 2+ years.

  1. You do not pay the court fees if you are found not guilty. You don’t pay the fee to go, you only pay once the case has its disposition

  2. ALOT! They may say 9:00 and your case may not be up until 3. So plan ahead. The court time is the time you report, not the time you hit the stand.

  3. Depends on the company, your previous driving record, claims sent, etc are all factors when the underwriters review your policy. It could go up 10 dollars per 6 mo, it could go up 300, who is to say

  4. From what I have seen, most times the LEO goes through his docket and finds each person to see if you are there and if you are going to contest it (he’s preparing for his cases). In some cases, if you get a chance to talk to him and you weren’t an ass, he’ll work something out. 24 over is a lot to ask to be knocked back. Hiring a lawyer may help, but no guarantee. All he is going to do, especially if he is well known, talk to the cop prior to the trial, get a plea bargain (such as 12 over vs. 24) and then you pay him a couple hundred. Unless you have evidence supporting you are innocent the price of the lawyer may not be worth fighting it with one.

lol in what state is it a good idea to pay a lawyer for a fuckin speeding ticket? I feel bad for whoever lives there. Here in Cali I’ve never heard of anyone getting a lawyer for anything less than a DUI. I’ve had a reckless driving myself but didn’t cost THAT much

Some of yall are acting like speeding makes the cars you pass just burst into flames or some shit. As long as you aren’t just a shitty driver (ie poor situational awareness), things will be fine. I’m 10x more concerned about driving around people on their cell phones…

Anyway, definitely do go to court unless its gonna cause issues at work or something. Sometimes you just get a lenient judge (I saw a guy get away with his 3rd DUI in 5 years a while back…), or the cop won’t show. It might also help if you can see anything wrong with the ticket the cop gave you in terms of information he wrote down. I’ve heard of tickets being dropped because of stuff like that.

On a related note, I spent about a hour of my drive to SC this weekend following a cop that was going about 90 in a 70. He knew the score.

I’d take it to court. Seeing as how this happened at 4am, the cop probably works graveyard. I doubt that dude’s gonna show up to court and wait around all day for your case when he could be sleeping.
