Yea it MAY prevent her from coming clean, but the more likely chance is that she’s never going to come clean. We all know that the more likely outcome is that the person is never going to come clean about their MAJOR fuck up whether they are going to get a punishment or not, and that the far more worthwhile thing to try and do as we continue to hurtle into the future is to prevent this shit from happening in the first place.
Call me crazy but I think being preventative, instead of hopeful that someone develops a conscience, is a more worthwhile avenue to venture down.
Accusing someone of rape is some serous business. Accusing someone of rape is not like accusing someone at cheating at Monopoly or even thief.
Once someone is found guilty, even if they are later proven innocent their life is still ruined. Rape is a very serious charge with the punishment for this is more serious than murder.
Only Piracy (not the copyright piracy, I am talking actual High Seas Piracy) and Treason is treated more seriously, and both of those crimes once convicted are automatic death penalties with no room for a “reduce sentence”.

Some say being allowed int he “general population” of the prison is kinder as you don’t have to deal with the isolation.

Ordinarily I don’t care what happens to the male in these instances because they took actions that open themselves up to these issues. But in this case he was just some random kid that got completely railroaded by the system, and that is definitely messed up. You are still supposed to be innocent until proven guilty, and legal proof was never just supposed to be the word of your accuser with nothing else.
The only way to fix this is to disbar the judge and force him to serve out the entire jail sentence. People are looking at the wrong person to blame. This judge should know better. If judges got punished for being criminally incompetent they would then start being competent. It’s that simple. The entire idea behind checks and balances was that nobody gets too powerful that they can screw things up, because the system was designed with the knowledge that most people are fuckups.
That has gotten warped with legalized bribery of politicians and judges, the executive branch completely overreaching in power and massive spying on US citizens, and no punishment for any actions for the protected classes, the rich and elite who can simply statutorily remove themselves from being subject to the laws that everyone else is supposed to be, such as insider trading which is legal for Congress, but nobody else.
It’s clear America sucks, but apparently the rest of the world is even worse, so America wins by default. Still doesn’t mean things are the way they should be.
Also I don’t know why you’d ever get a bench trial in a criminal case. Not one with severe penalties at any rate. But probably it wouldn’t have mattered, if a judge wants the case to go a certain way there is nothing anybody can actually do about it, hence when they fuck up this badly they need to be punished severely for it.

like said earlier, the checks and balances are just not there. if the state knew that putting a man in prison with very little to no evidence, who was wrongly accused of rape (or anything for that matter), would automatically cost them a million dollars (no lawyer needed. that would just be the automatic compensation), they would make sure their judges fucking keep their emotions out of cases and stay by the book and the facts. if women new that commiting perjury to lead to a conviction by falsely accusing someone of rape was an automatic 20 years minimum, no parole, they would stop the process early on and just say they lied, why, and face the consequences from there.

Is it better for an innocent dude to sit in prison because the scumbag that accused him is too afraid to come forward and admit it was a bullshit accusation, or to do what Evolution said and have a no-prison punishment as incentive for them to come forward? Personally, I think if it means a falsely accused person gets a portion of their life back and can be a contributing member of society again, I think that’s the better option. False rape accusations are shitty, but if the “victim” is willing to recant and free the accused in exchange for a lighter punishment, I don’t see why that’s a problem. Everyone wins in a sense.

the False accusation of rape is about as damaging as rape it self. Its a sigma that stays when you where ever you go, in many states you are stuck on the sex offenders list with no way off, with your address and whereabouts easily found on the internet. Instead of encouraging people to come forwards with the fact they falsely accuse someone, how bout some ACTUAL due process of law. The Judge was heavily bias in this case and would have ruled the man was guilty based on the girl’s word alone? No medical examination to see if the girl was sexually violated? What we need is to show people what happen to you if you make false accusations in the first place (regardless of the crime) without scaring off the victims with legit claims.
First off the false accuser should get all the same jail time the guy would have served and put on the sex offender list. It would be kinder for her just to shoot the guy in the head with a shot gun than how she destroyed that one guys life. I don’t know what cruddy things the guy do if any to get accused like this, perhaps his own stupidity but being falsely convicted of rape is way overkill.
If a girl come forwards saying she been raped, you take the poor girl to the hospital, as most rape victims are servery beaten, some victims do not survive the rape. Get her treated for her injuries (if any) examine her for the physical/ medical signs of rape followed by psychological exam. As if the rape actually did happen the poor girl would need lots of therapy and counseling. Rape isn’t about lust its about empowerment for the sicko rapist, its a salvage, violent crime. At the hospital you have your medical evidence and the psychological state of the victim. Was there any witnesses or camera footage? any evidence left at the scene of the crime?

well thats the worst part. the alleged rape happened when she was ten and he was 14, then when she got caught watching porn at 16, she decided, eh that one guy we all know, yeah he raped me 6 years ago. so the guy gets arrested and charged, has to bail himself out and all that shit, while this embarrassed 16 year old continues her lies and story to her family, because her mom is a stickler and probably a crazy bitch, thats why she decided to make up something so outrageous to protect her from the punishment of watching porn. then they all go to court, all make up a bunch of shit about how this guy was obsessed with their daughter, and blah blah, and the judge tosses him in prison with no physical evidence whatsoever, because well it never happened, and also because its 6 years old. i think in some states you dont even have any legal grounds after a certain amount of time. clearly virginia either doesnt have this law, or it still fell under the umbrella of time.

The statute of limitations on any crime varies from state to state and depends on whether the crime is prosecuted as a misdemeanor or a felony.
I did several searches on the web, they all come up with the same answer.
In the State of Virginia there no statute of limitations for felony charges, that includes Rape which is listed under assault in Virginia law.

What if she was the one who had to pay that $90k back? That’s a lot of money and you know she’s probably not making anything close to that. It’ll take her most of her life to pay that off. Community service makes it so that she’s actually doing something constructive that helps the community at large. She was shitty to make the accusation, but she’s not violent or dangerous, why should she sit in prison when we can make more constructive use of her? Why is the only acceptable outcome of this for you prison time?

After doing a bit of reading on the topic of DNA evidence, it appears that in a lot of rape cases, they don’t even bother to test the rape kits, since in 90% of cases, the victim knows the perpetrator. What that tells me is that law enforcement tends to go into these cases assuming the woman is on the level with her accusation. So what the real issue to me is, law enforcement is cutting corners rather than checking things out like they should.

This would never have happened if this…lady… had never lied in the first place. And this wasn’t just her making up something in the heat of a moment(only to immediately take it back later before it blew out of control). She actually let this lie go to trail, let the man be convicted, and let him sit in prison for five years while going on with her life. That erases any sympathy from me towards her.
If hard punishment likes this deters people from making false rape claims then so be it.
You are indeed correct this is very short-sighted justice. 90k and 2 months out of a five year suspended sentence is very short-sighted justice. She should’ve had the book thrown at her and this judge should be being investigated for a violation of legal ethics(if not the constitution for giving this guy the exact opposite of a fair trial). That would actually be justice.
Not only does shit like this hurts the accused permanently(no matter if he’s cleared this arrest will always show up in his background check; not to mention the permanently damaged reputation just off of being accused); shit like this also hurts REAL victims of rape, many of which have a hard enough battle to fight in court, the last thing they need is to be deprived of resources, time, and boots on the ground that could’ve been spent towards their case instead of some bullshit goose hunt concocted by some chick as a way out of personal embarrassment or(just as likely and can be both at once) spiteful revenge.
I guarantee you there are many cases where **you’d **say a person committing a crime yet coming clean about it should never the less face the consequences of their actions. Punishment for an offense is just that, punishment, it shouldn’t be left up to some whimsical notion like “well at least she did the right thing. Hey, how many years should we shave off for her coming forward? Let’s go check our brownie points flowchart”. While it is certainly decent of her to come forward(for the completely indecent act she committed years before), she should nevertheless face the consequences of her actions.
