Of course the problem is, while Superheros might get some stigma, the Government is looking suspect after Cap 2 themselves. The only reason the world isn’t screwed right now, is because Justin Hammer is an idiot.
The problem is that none of the people in the MCU make any effort (aside from Banner for now) to conceal their public identities. Tony already outed himself, Cap doesn’t have a life anyway, and Thor lives on another plane of existence.
Aside from Shield operatives I don’t think anyone besides Banner has a secret identity.
It could change depending on how A2 shakes out though.
Since the movieverse is going cosmic I would like them to get another crack at Secret Invasion. The potential that story had is too good and it could be done right. Avengers: EMH proved it can be done.
In regards to the partial ownership. With Quicksilver and Scarlet Witch its really simple since Marvel Studios can’t mention Magneto and Mutants. (Personally it’d be awesome if they made those two Stucker’s kids). Skrulls seems tricky considering the Chitauri were skrulls in the Ultimate comics.
The only thing tricky with Skrulls would be the using Super Skrull. Since Marvel can’t use the Fantastic Four there would be no basis for him to have those powers.
Can’t they just make references without using names?
Like what if they said"4 astronauts with powers"or even"some guy who jumps all over rooftops in New York City." I’m sure they can’t sue over such vague references.
Every time I think of these licensing issues it makes me sad to consider just how much more awesome and cohesive of a universe we could be building with all the Marvel properties operating on the same page.
