Throughout the multiplicity of claims involved, those are the least compelling. What are we talking about - image rights? At what point do I show Sanford, in which specific videos? Was there an expectation of privacy? What jurisdiction was XXX filmed in, and what are the relevant image rights there? At what point was consent not given and yet I filmed anyways (answer: never)? At what points did I have explicit verbal consent vs implicit? There was the stupid game of “guess the Marvel player” before, and people were guessing blindly - are we sure Sanford is the player of record? If I misidentify someone else as Sanford, or Sanford not as Sanford, what’s the damage I’ve done that entails action? What’s the commerce here?
What if we took an important legal step back - and this is why I think you’re talking with your head stuck far up your ass - what other product elements might be construed as infringing? How are people enjoying their “custom” Marvel with “custom” music? :rolleyes:

If anybody at all wants their videos to be removed (which would be a minor pain in the ass right now because of the ongoing ‘recent’ script which I’m doing so that Fugee has time to finish encoding the excellent videos only he has from Season’s Beatings), that’s probably something we can handle privately.
I will typically lean towards an initial “no, but get back to me in a month or two after you’ve had time to think it over” because I think it’s easy to lose perspective. If after a month of thinking about, that’s the way you feel, I don’t see any real problem with that - or I can add you to the “hide” list in the Search page if that’s what you want, or any number of things which will be much easier when the “Recent” unlock script completes. Remember that I’m not doing this to make money - I’m just doing it to provide a resource for the community. I think most of us have forgotten the days of trading videos on stuff like DrFunkenstein’s legendary GoForBroke hub as we move into the post-commercial (!) post-download(?) YouTube age, but I’ve been willing to ‘tough it out’ (still spend $170 monthly just cuz I like y’all) to provide a little more glue to our foundations for a while. You wanting to divorce yourself from the process for whatever reason is your call. I’ll just think it’s weird.
In Sanford’s particular case, I know we had a conversation at Evo that he may never believe (plus he may have very understandably been out of his mind at that point, so may not recollect any of it), but was true. There’s been subsequent rumblings on his part that he misunderstands (or maybe simply doesn’t care, which is also fine) my feelings for him, and that’s probably something that’s best handled between the two of us. If we need to grandstand about it or inject ‘legal’ interpretations into it, that just fucks the ability of two people to have a normal (e-)relationship.
It’s like – Dark Prince never really got that I just don’t care. I play Marvel to have fun, and I break my back taping shit and spend enough to take a really nice trip to Europe because I think it’s really important to give back to communities. And anybody who’s known me knows I’m way burned out at this point and stumble blearily through taping stuff, but you know I’ve kept doing it because I think there’s a lot of great people who appreciate stuff. Even if some days my only fan may be ruin–.

Hey SRK has law students, attorneys, and lawyers of various kinds, ya know. I’ve personally met 3-4 and spoken with several more on here. I myself am a lawyer with specialties in copyright and internet law who’s done some scholarly work on things like mods, machinima, and fighting game match videos, and I expect to begin publishing articles on those or similar subjects next year. What do I think about this stuff? Come on, man, obviously I’m down. But intellectual property law and cyberspace law have lots and lots of adapting to the new realities of new technologies, so while no one has ever gone to court over whether unauthorized match videos are legal, it’s a pretty sure bet that they’re not.
But that’s not because the players in the vids have some valid claim. I can’t think of any legit reason based on any law I know about that would give a player in a match video filmed by someone else any reasonable expectation of having any rights to that actual video. Maybe some privacy-based thing like appropriation? That would require both that the vid make money and probably that the player’s face be on screen just to be mentioned in court, but even then, it would probably have to be a lot of money, the vid would have to use the player’s likeness unfairly (ie without express or implied permission, which is unlikely because every player knows when he’s getting filmed and can stop it but never does), etc. No way, man. This isn’t really worth considering.
No, the reason match videos probably aren’t kosher is that they probably infringe on the rights of whoever owns the rights to the game itself, since the video takes in large part the copyrighted audiovisual work of the game (that is, the graphics, sound, and music). All the rights to that audiovisual work are totally owned by the company that owns the rights to the game (obviously), and those rights include the exclusive rights of reproduction, modification (including any derivative works), and transmission of the work. Match videos probably involve something like reproducing or modifying the original audiovisual work, and sending match vids around is probably something like transmitting that original audiovisual work. Again, totally untested in a court of law, but these are pretty good as best guesses go.
Anyways, Preppy, don’t worry too much about being liable to the players shown in your videos, both for legal reasons and because obviously no player is going to sue you anyway. The only thing you (or anyone who makes match vids and sends them around) have to worry about is Capcom, but really you don’t even have to worry about them because they know about match vids and are obviously down with them enough to have never sued anyone on them. They can always change their minds, but don’t count on it. I’d personally like to see things like match vids be legal so that we don’t have to worry that the companies that own our games will start suing us, but in the meantime, whatever, don’t worry anyway.

You are totally spot on in agreement with my thoughts upon this non-contentious subject, especially the notion that it’d be Capcom or A/V rights holder(s) that would actually have reason to object. Hence my bafflement: I’ve worked closely with A/V related law (it’s no secret I’m a multimedia developer, and most of my work for some time has been in regulatory capacities), and your comments make 100% sense. This is a good elementary primer, and I think the key claim if anybody ever cared to press this matter would be the transformative nature of match play providing an educational experience. There’s a value add when it is people playing and not the AI.
I think I’ve operated and continue to operate in good faith, and as such it is not something I’m concerned about. A large part of the reason the site is up is to support Capcom/Capcom games, and they’ve generally been pretty supportive of those types of actions. But invoking “legal” in this realm is the equivalent of shouting “Hastur Hastur Hastur” in Arkham, and I hope people understand that they’re insane to do so. I would hope that anyone claiming to be a real lawyer would understand that. And if you are a real lawyer and don’t understand this arena … for ---- sakes man do your homework first. Seriously. We all operate by kingly benevolence, and we would be well suited to quietly be kind to each other and never accidentally awaken the legal demons that could choke the life out of parts of what we enjoy. :tup:
