I think its his avatar that bugs me the most, those are some of the most punchable faces I’ve seen in a long time. That along with his personality of I am a stay at home mother who depends on my slave wife to provide. Men with no drive to be successful/independent are annoying, most of all I feel sorry for the kids who don’t get quality time with someone that could pass on quality traits.
I read your story and the charges and I came to the conclusion of Assault and Felony Battery. It’s both because you walked up on him with the intent to hurt him (Assault). He threw his hands up to defend and you swung at him (Battery). He ended up with broken limbs and possible disfigurement which makes that a felony.
It may be possible for your lawyer to get you out of Assault because the guy did throw up his hands so if he can get it down to mutual combat you’re gtg. If your lawyer can also prove that by him throwing up his hands, you felt threatened, were in imminent danger (him pulling up on you and hitting the girl seriously puts the favor on you) you felt you had no choice but to fight. Even if this charge gets dropped, Felony Battery could still stick.
edit: I checked on voluntary combat and unfortunately that’s not a viable defense b/c excessive or unreasonable force was used.
Deadly weapon charge will be dropped. Your fists and legs do not count as deadly weapon regardless of the myth that black belts have to register as a deadly weapon.
Felony Robbery will be dropped. For them to hit you with Felony Robbery and have it stick, there has to be a sufficient violence and intimidation, forcing them of their item. They also have to prove that you intended to permanently deprive them out of their item and that’s not true b/c 1, you weren’t the one who did it and 2, it was thrown into the bushes. Rebecca’s charges will likely be dropped to petty theft.
DUI will be dropped obviously.
My take: Police tried to hit you with as much charges as possible, hoping that one of them will stick, even if they know that you aren’t actually guilty of that level of crime. It’s fucked up, but minorities getting tangled up with the law is not the business. I don’t want to sound racist or anything, but a lot is in favor of the white guy. His skin color alone gets him reduced sentences/charges. It’s fucked but that’s the way it is.
My friend went to federal prison for two years and if you’re going to federal prison, there are no reductions on sentence. Whatever you get is what you serve 100% They will try to screw you over on halfway house and once you get to the halfway house, everything is stacked against you when you are trying to find a job.
If you are going to federal, most likely you’re going to the one my friend went to. He told me that he was normal going in, but that place made him crazy. There’s factions of people (yes there’s an Asian faction too). Things are really fucked up in there. People will try to mess with you when you first get there and if you don’t stand your ground, they will try to exploit you for all the time you are in there. If one of your people has sufficient cause to beat up another guy from another race, then EVERYONE must participate.

Hate to say it but im pretty sure you can get a dui even if under .08. you could get one for a .02. it depends on the officers judgement to some extent. Everyone has a different tolerance and they know that which is why I think it doesnt really matter. Either way you should have been under the influence in the first place, does this mean you were over .08 when you first left where you were? stupid.

Well, if it’s going to trial, it’s definitely not a good idea to keep this thread up and running.
However, why aren’t they bringing up the fact that the guy hit your girl with his car? If you can prove that he hit her and caused her injury, that will earn you points with a jury as you can say that your main motive was to protect her.
There’s no getting out of the fact that you beat the other guy–he has injuries to prove it, but you want to look as good as possible, and even with the circumstances you shouldn’t let them get away with painting the other guy as an innocent victim when he did fuck up your girl first.
