i made similar mistakes as a youth. i once got a no seat belt ticket because i was so eager to be cooperative i unbuckled my shit and had my wallet ready before he got to the window. cop walks up, says he never saw my seat belt buckled, adds it to the ticket. had to take a sobriety test because i was talkative another time. excuse me for trying to be friendly
anyway never volunteer anything to them until they ask. allow them to do their job, but don’t think youre doing them any favors. you usually end up only hurting yourself. like seriously just sit there and do nothing unless they tell you to. dont move, dont talk, and keep your hands in the open. depending on the cop they can and will use anything against you
since you passed the alcohol to the cop without him asking who it belonged to, he can use that as an admission of guilt.
“is that an open container?” you reach for it like it’s yours. so to the cop, it is yours. especially if she didnt speak up and claim it.
you can go and say it wasn’t yours or whatever, but then its your word vs the cop. cops always win in this situation unless you have a witness…
so the only way around it at this point is for the chick to go to court with you and claim it was her liquor and deal with whatever consequences they have for her. but you wont get anything tossed out on a raw denial
also, from the way he told the story, i think the cop was looking thru the windows of the car with his flashlight, which is perfectly legal, and he doesnt have to ask, and saw the bottle in plain sight

Hey guys, not to hijack, but I have a legal question, and we seem to have legally hip members posting here. My first real job (full time), I was working for a Rooms To Go supply warehouse (that was staffed by, no joke, like 70% illegal aliens) in the packaging department back in '98. I went on vacation one time in 1999 and came back to find my radio had been stolen. The next time I took a vacation, I left a note next to the radio stating “Do Not Take”. I was in a hurry so I used a boxcutter blade to pin it to inside wall of the cardboard box that held my personal, purchased with my own money work supplies. (I used the box like a locker. Had it secured to a support beam with duct tape and everything) I got back and they asked me to leave, saying that I had threatened people…with a note that wouldn’t have been found had someone not entered my work station box and, again, stolen my radio. Could police have charged me with anything if they had been called?
