Regardless of the stupidity of the woman, posting something like this online when your job is to monitor potential criminal activity is abhorrent IMO. People do stupid things all the time, doesn’t mean they deserve to be publicly humiliated unknowingly.

I thought it was stupid too until I read up on it. They actually made the coffee WAY too hot, because it has to sit there sometimes and they don’t want it cooling down too fast before they serve it. So it was like almost boiling hot. Kinda legit I guess.

Having studied that McDonalds case, I can say without a doubt that the woman had a horrible, horrible case and was fighting an uphill battle the entire way (McDonalds had a strong defense), but once it got to a jury trial, all bets were off. In civil claims, jury trials are less about evidence and facts than emotion and “right and wrong” for leypeople.
You would not believe how many cases we lose at trial when defense shows the jury a poster-sized photo of our client’s lightly damaged vehicle. Even though we have stacks of medical records, engineer reports, etc all confirming that a low-velocity impact is capable of causing the type of injury our client sustained, juries see the photo of the scratches, look over to our client (who appears normal from the outside), and we lost. Damn the evidence, it’s all about impressions and emotions.

There’s an email floating around the office of dumbest court rulings of 2010. Basically thieves suing the people they were robbing because they got injured in the escape, and dumb ass parents or kids not taking responsibility. I figured it had to come down to jury sympathy, but it’s like…really? How do you side with the stupid person, especially considering how much the defendant will have to pay? Even if insurance pays, we all end up paying for it eventually.
And most of it went to her lawyer fees so no she ended up with almost nothing.
How the hell is it her fault they handed her coffee that was so hot it scarred her when it spilt? She didn’t sue because she spilt coffee on herself. She sued because it was soooo fucking hot it left permanent damage when she accidently spilled it on herself. Thats negligence, there was no reason for that coffee to be that hot. There is no reason to serve people liquid thats scalding. You can’t even interact with it at that temperature.
Again, the facts actually favored the defense when it came to recommended brewing temperatures, evidence that the coffee was not unreasonably dangerous, etc. But once you have an elderly, severely injured white woman “fighting” a corporation/big business like McDonalds, with a bunch of regular joes watching, all logic and evidence goes out the window; it will usually boil down to emotion and personal ideologies re: fair/unfair. Also, the jury did find the plaintiff partially at fault.
Uhh any liquid that is hot enough to scar your genital area shouldn’t be sold for consumption.

I believe the manner in which she opened the lid caused the cup to spill… which is why I’m assuming the jury found her partially at fault.
Most coffee is quite hot. Hot things tend to damage you. If someone gets hit by a car can they sue the manufacturer for making the metal too hard and unforgiving to human organs? How about for the engine making the car move so fast that it actually broke their bones? Paving company for using material that scrapes skin? Certain things have certain qualities. Act accordingly or get hurt.
You spilt coffee on yourself. You have two options: 1. Be more careful in the future. 2. Stop drinking coffee if it poses too great a threat of physical harm.

yo do realize that the reason her burns were so bad is bcuz she was wearing cotton pants or something and instead of taking the pants off with the scalding hot liquid she sat in them until deciding to hit up the hospital at which point they were removed.
again, there was nothing “instant” about her injuries. if i spill scalding hot coffee on myself right now, i’d stand up, yell some obsecnities while getting the liquid off me, i might have some minor 2nd degree burns.
again the only “negligent” action was her sitting there in scalding hot fluid. if you slip and fall while crossing train tracks, you get up and off the tracks; you don’t lay there and wait to get hit by the train.
