Working at a personal injury law firm for the past 4 years and investigating liability claims, it shames me to see this nonsense. I hope this lady has to pay the mall’s defense council and the courts for wasting everyone’s time.
EDIT: A common “tell” that people are grasping at air with liability claims is the standard “I could’ve died”, “what if it was a small child?”, “I could’ve been seriously injured”, etc. Hate to break it to you, but speculative damages don’t mean shit. Settlements and judgments aren’t awarded based on shoulda, woulda, coulda. Essentially, if the actual damages are so insignificant that you have to start emphasizing what didn’t happen in order to make you case, you’ve already lost.

Will the court even take the case in the first place?
The retard lady can file a lawsuit, but that doesn’t mean she’ll be successful in making a recovery. I suspect this is what’s actually going to happen:
- Retard lady contacts the mall’s liability insurance carrier, demanding x amount of dollars to compensate her for her damages.
- Liability insurance carrier laughs, shrugs, then sends retard lady a denial letter.
- Retard lady then has her retard attorney file a lawsuit.
- Against his better judgment, retard attorney files a lawsuit on retard lady’s behalf.
- Judge reviews suit and recommends that all parties use mediation to potentially resolve this frivolous claim.
- Retard attorney comes to his senses, realizes he doesn’t want to pay for mediation costs, then withdraws representation.
- Retard lady is unable to find any other attorneys stupid enough to take this to mediation and beyond (trial).
- Defeated, retard lady texts while walking on the sidewalk and falls into an open manhole cover, dying instantly.
- In heaven, God high-fives Darwin.

a student threw a fire extinguisher from a 7 story building during a university fee demo. It didnt hit anyone but the kid was given 3years in jail for attempted murder, having owned up to the incident when he didnt have to.
I saw the fall last night and saw the thing about her wanting to sue about an hour ago. This is going to be one of the funnier lawsuits if she can actually pull it off. I’d like to see the whole transcript of this case after it’s over. That’s if it happens that is. The mall should counter sue the shit out of her.
I suppose you have to look at intent. Intentional acts resulting in injury/potential injury are handled by the criminal justice system, which have different parameters and rules. Injury stemming from negligence is handled by civil courts (tort law), and as such, speculative damages mean don’t anything.
She’s reacting too fast, she shoulda just held out for a web redemption.
The student wasn’t a victim though, that makes a pretty decent difference.
The main difference is that the kid intentionally threw the extinguisher off the roof of a 7 story building into/near a crowd of people below, then admitted to it.
Slightly different scenario; If this kid was carrying a fire extinguisher on the roof, slipped, and the fire extinguisher flew out of his grasp and plummeted down below, I doubt that he’d be facing criminal charges.
Now, how the DA would prove intent is something of a different beast (a confession from the defendant always helps), but my point is that if there’s intent, there most likely will be criminal consequences. If there’s simply negligence, you’re probably just looking at a civil claim.

People will try anything to get free money. The retards who are accident prone are, not surprisingly, the ones who try this most.
To this day I still laugh when I remember the person in the news who sued McDonalds because they spilt coffee on themselves and the coffee was hot.

You should probably do some research on that case cuz it’s actually not very funny and she, despite winning, ended up with almost no compensation and her burns where like 3rd degree or some shit. That coffee tore her up real bad there was no reason for it to be that hot.
I’m not trying to back up people who make stupid suit claims like this woman and her stupid swimming session at the mall but that McD’s Lady has been misrepresented in the media real badly. That coffee really messed her up. It’s not a matter of her being stupid because people accidentaly spill all the time.
