I don’t think anyone is asserting such a polarized stance: “It’s all the judge’s fault, the teen did nothing wrong”.
The sentiment I keep hearing and expressing is more like “The teen messed up, but the judge is the one who ultimately had all the power and holds the majority of the responsibility”.
^And I humbly disagree there Match. The ultimate fault of such an action will always fall primarily on the one who committed the action, at least ideally. None of this would’ve come to pass had she not concocted that bullshit story. Just like with any other crime, whatever the background circumstances of it are(in some cases they are quite understandable, like someone in backbreaking poverty stealing fruit or something), the primary responsibility for committing the crime rests on the person who did it. This taking into account the sheer failure of the judge and the judicial process which even you and I of all people can agree on.
If a 6 year old child comes up to me and goes “The neighbors put a monster in my closet! Let’s go shoot them!” I, as an adult, have the responsibility to not act on the false allegations of a child and properly investigate said claim. If I act as if this allegation is real and go shoot up a house because of a closet monster, then it is I who am committing the action that is leading to the most unethical result. The child likely had no power to enact this on their own.
Judges have false accusations come before them all the time (whether from an adult or a child). That’s why they’re called judges, because they have to make rational decisions in the midst of such complications. If a judge doesn’t do their job properly, innocent people suffer.
I could also assert that the ultimate fault of the man’s incarceration falls on the judge who made the sentence, as that is committing an action as well. None of this would’ve happened if that bullshit sentence wasn’t passed.
The teen’s allegation wasn’t enough to put a man in prison. It took someone in power to foolishly act upon it to make that happen.

However, that you proposed a story of a very young child(not a 17 year old teenager who is for all intents and purposes a young adult) making up a story about closet monsters, resulting in their parents shooting the neighbors, as analogous to this case is ridiculous stretching
The person making said allegation is a minor, who does not have the power to carry out the unethical consequence of their allegation on their own.
The person in power has a responsibility to properly determine how said allegation needs to be acted upon. If the person in power reacts in an irresponsible or irrational way, it’s not the fault of the person making the allegation.
I can’t believe ya’ll are calling for leniency for women that ruin somebody else’s lives. Saying that we should water down the punishment to encourage them to come forward is insane, you shouldn’t be teaching young women (who are the primary ones to do this) that it’s okay to ruin a man or woman’s life so long as you say sorry later. You need to ingrain a stronger sense of personal responsibility into them, not just say oh well, shit happens, he COULD have raped you in another timeline.
Imagine if a guy hit somebody in his car, never told anybody for five years and then came forward and said ''Yeah, I did sorta run over that dude and completely cripple him, but coming forward counts, right?" Should he get a minimal fine and a couple months in prison? Fuck no, he ruined somebodies life, he should be put away in jail for a LONG time. Chances are if you’re such a vitriolic bitch that you’re going to ruin a guy’s life and tarnish his reputation, you aren’t going to come forward anyway. We should be punishing the people that do come forward to the full extent of the law, not treating them like a kid that admitted to pushing over another one in the sand pit and giving them a slap on the wrist.

Exactly. Laws like this definitely need to be changed, as it’s one of those laws that favors girls/women 95% of the time. The Police/Government always happen to take a woman’s word over a man’s with NO PROOF OR EVIDENCE that she was raped by a specific man, & it’s always the innocent man that gets punished.
Another law that favors girls/women that needs changing: Child support.
Even when a man has proven that the child that he’s raising isn’t biologically his through a DNA test, they don’t get any say once he signs the child’s birth certificate, & he still has to pay child support for the child until he or she’s 18 years old, all because of the law “following the best interests of the child.” Again, the law always taking the woman’s side, & the man gets punished. They usually are. I know plenty of attorneys working the sex crime units at various prosecutor’s offices. Most are angry women that think all men are constantly trying to rape them. It is pretty funny. They will usually launch into this whole schpiel about it.

I don’t know if you read that link I posted on page 2, but it was written by a woman who was/is a sex crimes lawyer and she was saying that there are piles of rape kits that never end up being tested in rape cases. Her take was that because in 90% of rape cases, the victim knew the attacker, there was no need. Apparently this happens everywhere.
