If he got it from two sources, its relevant news based on what’s going on with E3. Nintendo can go suck a fucking dick. Write an article and then e-mail nintendo a picture of Grumpy cat.
How are could they even possibly claim damages on that? there’s seriously 0 financial loss from writing an article about rumors or other nonsense the day before they deliver their presentation.
I mean that’s a coin flip though. I wouldn’t try to play russian roulette with this for 5 secs of fame. Nintendo might have found out how she was getting her information. She apparently has been saying prior that she was planning to leak the direct before she got the C&D from them.

Look, she’s either a journalist or isn’t. If she has a press pass and protects her sources, there’s not much they can tell her. Hell if they have a website and do independent journalism, can show that in court, not much they can legally do.
Paparazzi do worse and they’re basically untouchable. That person hasn’t signed any NDAs from Nintendo. He/She isn’t beholden to Nintendo in any way, shape or form.
So they are an actual type of journalist or just some idiot in a discord playing the spoiler game?

From what I’m reading on the story she’s given names of other people who have similar info to what she has and also given the discord for where the leaks happen. So Nintendo probably dug in and found out where she was getting her info and verified the sources that have the NDA’s attached to them…I’m only guessing on that since I don’t know the legality when it comes to leaking stuff. Usually when it comes to leaks most companies can choose to not respond to leaks and rumors and by doing that usually people either can choose to believe or no. This is probably a different situation now where the leaks have been 100% legit and she’s possibly has given away the source of the information. It’s quite like someone in the backroom of a gamestop taking a picture of materials and then leaking it. Nintendo actually knows her full name and where she lives and everything so it sounds like they dug deep on the info on her. And I don’t know what type of legal gymnastics Nintendo could pull if they consider the leaks to be a means of them losing money since the spent the time and effort to make the presentation. Like I said I don’t know how the legal stuff involving that works that might be something that might be a question for Ultra David but if I was in her shoes I wouldn’t risk it.
