Common misconception. There is actually two viruses out there, HIV-1 and HIV-2. The predominant one all over the world and the one we generally refer to is HIV-1. HIV-1 comes in 4 strains (M,N,O,P) and the predominant strain is M. Within HIV-1 M there further exists subtypes (A,B , C, D, F, G, H, J, and K). The subtypes within Strain M are genetically distinct, and the differences between them often expresses itself in the speed of progression of the disease and varying risks of transmission (some are worse than others). The predominant subtype in North America and Europe is B for example, which is what a lot of the drugs are designed for but they can work against other subtypes.
Bottomline, you can become a carrier of more than one HIV virus, or more than one HIV strain, or more than one HIV subtype. Each independent from the other, and some may not respond to medication at all.

The only way he’d be “knowingly infecting” people would be having unprotected sex with people he didn’t tell he had HIV after he knew for sure. Technically, the same would apply if he had protected sex with people he also didn’t tell, but the risk there is significantly lesser.
Otherwise, it’s not “knowingly infecting” or even attempting to knowingly infect someone if they’re informed and consent–there’s just the acknowledged risk that sleeping with Charlie Sheen as of 4 years ago means you might potentially get HIV. There’s a huge difference there.
Granted, he may well be a scumbag who is lying about telling certain people he had sex that he was HIV+, but assuming he’s telling the truth, then that’s not knowingly infecting people. Unfortunately people don’t generally become (willingly) celibate once they know or even just suspect they have some type of STD. If they did, then STDs would have died a long, long time ago.
