I read that article and Iām not sure itās as hateful as people make it seem. It sounds to me like they want to have some form of agreement as to what constitutes sex discrimination in an era where it seems like anyone who wants to can claim theyāre the opposite sex. One of the comments was from a trans person who said that they had been thru the surgery and that they thought someone should have to go thru that in order to legally claim to be the opposite gender they were born as which I think is legit.
Granting trans people hate crime protection/civil rights status is complicated because while being gay, black, etc isnāt a choice, being trans kind of is. I donāt have any prejudice against trans folks, Iāve met and had good conversations with several, but their situation is a complicated one legally speaking.

That is a bonkers statement. You could definitely mean doing something about it via surgery being a choice , but if not, that is the same type of logic people use to dehumanize trans folks.
Being trans is certainly less of a choice than religion is, and weāre perfectly comfortable with granting hate crime protections to religious groups.
The underlying gender dysmophologies that cause people to seek to transition donāt seem to have any element of choice. Plus there are biologically intersexed people who donāt have anything at all to do with being trans but would still be unfairly affected by legally codifying strict gender assignment.
To me it makes MORE sense for them to get hate crime protection if they have the surgery than it does some guy just going out in womenās clothes. Iām not trying to dehumanize anyone, just saying that this is a really complicated issue legally. AS FAR AS WE KNOW, someone being trans is entirely behavioral, not biological, so until science has said, āyes thereās a biological component to thisā all we have to go on is that trans folks could potentially go see a therapist and over a period of time become relatively okay with themselves. This is all relatively new territory.
To be honest though, I donāt think ANYONE should get hate crime protection because I think it makes more sense to prosecute people based on their actions rather than their thoughts.
How do you believe that dressing and living as the opposite gender is not a choice? You yourself could do that same thing, and yet you choose not to. We have no record of any biological or genetic impetus for doing so, which is probably in part because there hasnāt been enough study on the subject but until there is and we can isolate genes that play a role, then we have to assume that choosing to live as the opposite sex is a choice.
Why can someone born a male to claim to be female, and yet when Rachel Dolezal claimed to be black, that didnāt fly? Theyāre essentially the same thing.
People with Klinefelters are different. They were born that way biologically, and they had no choice in the matter. Most of them are distinctively male or female also, itās just that they have different genetalia. This is a whole different kettle of fish from trans people who have no biological differences that we know of from people of their born sex, the difference is behavioral. Until we know whether or not there is in fact a genetic link to body dysmorphia, all we can assume is that itās behavioral, and that it is in fact a choice.
Again, I say all this not to be hateful, or to dehumanize anyone. Iāve met and conversed with many trans people, even before the whole trans thing was as well known as it is now, and they were all nice people. But they are an exception, and if we definitely our laws and standards by the exceptions, then all weāll end up with is what weāve already had.
There are MANY factors beyond genetics that drive biology, and thinking you need to find a definitive genetic etiology to establish a phenotypic syndrome is simply not factual.
What factors are you referring to and how do they play a role in the shaping of your biologic material?
Environment, exposure, infection, developmental microenvironment, cellular microenvironment, oxidative stress, DNA hypermethylation, DNA imprinting, steric effects in transcription, post-transcriptional modification, proteomics.
Iām sure there are probably a hundred other things Iām forgetting.
