Some things are protected by higher federal law but it gets murked up arguing private vs public when it’s on the internet and if it’s on their site, whose content is it. Again, if they state that whatever you post they can sell, they can or have good reason to believe they can get away with it. These are lawyers of Facebook, a multibillion dollar corporation, that suspect they can get away with this so this is in no way clearly “illegal”, hence why they are actually trying to go through with that.
