He didn’t approach the guy with the intention to kill him; that’s 1st degree murder. Manslaughter is when you’re responsible for somebody’s death whether that was your intent or not (i.e. when you get drunk and kill somebody).

On Minnesota’s definition of it:

Minnesota law originally defined third-degree murder solely as depraved-heart murder (“without intent to effect the death of any person, caus[ing] the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life”).[7][8] In 1987, an additional drug-related provision (“without intent to cause death, proximately caus[ing] the death of a human being by, directly or indirectly, unlawfully selling, giving away, bartering, delivering, exchanging, distributing, or administering a controlled substance classified in Schedule I or II”) was added to the definition of third-degree murder

It being 3rd degree means it a different crime not that its any less serious than 1st degree murder. Well I mean, premeditated murder is more serious in general but eh, you know what I meant to say. It doesn’t get treated like its a lesser deal. What it does create is different requirements in evidence for prosecution. So you’d have to provide a motive.

Take for example the Zimmerman trial. The original DA didn’t want to pursue the case because the evidence wasn’t great (this isn’t saying that the whole situation was fine, just that what you could bring to court wasn’t going to really hold up like people wanted). He got replaced by somebody who went ahead and charged him with 2nd degree murder. For that you have to prove that he intended on killing Trayvon. Problem is that evidence didn’t add up on that.

On the other hand, they could’ve gone with involuntary manslaughter and had ample evidence of him basically starting a confrontation that didn’t need to happen that lead to somebody’s death. Its very likely they could’ve made a case for that but because of public outcry and people not necessarily understanding what charges mean for the evidence presented and how the jury is asked to view the evidence, they got the result that they got.

Makes sense to push a charge that’ll actually stick. No way they’d get 1st degree. I’d argue he had full intentions of killing by the length of the confrontation, but he’s more likely to be found guilty and it’ll come downs to how many yrs they dole out.

That’s what they’re supposed to do. something happen, they look at the evidence and then charge you. I kinda wish we had an actual law person here to help round out some of it.

Either way, he should be getting charged based on what they have evidence for. You aren’t gonna get him for murder 1 or 2 (if MN has a murder 2 statue) people the evidence doesn’t fit. Involuntary Manslaughter through being irresponsible though? Yep.

But when charges are filed, its going to be up to community leaders to explain why things are charged a certain way and what it means for the trial. Then you tell all the dumb dumbs asking for murder 1 to STFU because he’d skateboard the fuck away from the court room not guilty.

Is why people skate away from convictions. All the prosecution has to do is show that they didnt restrain him properly on top of the fact that he was pleading with them about his inability to breath. Bam, there you go, easy to put together manslaughter case.

Instead they’ll ask for murder 1 which would require the prosecution to provide evidence that thw officer went in with the intention of killing him by putting his knee on his neck because he knew that combined with additional health issues thst it would kill the guy.

Guess which of those has an actual chance at trial?

Guess you skipped the part that included the restraint by officers.

Just saying if you killed someone with a pillow you wouldn’t show signs of traumatic asphyxiation or strangulation either. This isn’t the full report nor exoneration for the officers involved.

On the other hand, right now they can start explaining why him being restrained in a way other than how they are trained, compounded with other issues, lead to his death. If the officers didnt do what they were supposed to and somebody dies, its manslaughter not murder.
