Sticks for Joy: Charity Sticks (Pre-order SFJ shirts!)

Charity organizations use the money they get from events they organize, sales and raffles to keep going. It’s not like anyone is getting a payment for themselves out of the money. If the organization keeps going so does the charity it makes. I don’t see why you guys are making such a big deal out of it. It’s like like most of them do and makes sense.

NOW, on the credibility issue, it’s imperative that SFJ becomes “legal” as an organization.

I think the difference comes from the fact that Charity organizations’ overheads are the overhead covers both what’s done to raise money and what’s the overhead necessary to directly help people. With an organization that’s only raising money for another charitable org, it becomes awkward for the benefited charitable org to endorse the project because they have no control over how much of each donation is being taken for administrative purposes.

The fact of the matter is that Non-Profit Organizations can get in a lot of legal trouble if it’s found out that they’re misappropriating funds donated for their cause. Protecting against abuse of donations is one of the points of the 501©(3) structure of regulations in the first place. Working with and endorsing an outside org, then, becomes a liability for an NPO if there’s any overhead that comes out of donations, which is why Child’s Play only will list events, etc. that donate 100% of proceeds.

Unfortunately, raising money for charity is not, itself, a charitable non-profit-status-worthy AFAIK.

At this point, I believe that, at least in terms of logistics, SFJ needs the ff.

-More people working on it, especially for events.
-People willing to donate stuff.

For the US, a Non-profit has to have by end of the year a zero Profit or zero balance.
Funds can be used to fund future events, even pay full time employees.

My Mother is a full time paid employee for a non-profit charity organization so I have and idea what a non-profit functions.

Yeah; the trick becomes proving that. If you want to be considered a non-profit (and thus trustworthy of peoples’ direct donations to you), you have to go through a whole lot of legal procedure to prove that fact. This procedure adds a massive amount of overhead in the form of both cost and time investment (not to mention legal fees for hiring someone to make sure that you’re not getting yourself in trouble). Forming SFJ into a 501©(3), right now, is just not in the cards due to it’s small scale.

Thus, two options: go the route of taking peoples’ money and promising that it will go to charity, which means that (unless an LLC or something is formed, which is a further expense) the person who takes the money becomes responsible for taxes owed as income (if an LLC or other corporate entity were formed for SFJ, that entity would then have to pay the taxes instead), or have the donations go directly to another, pre-established charitable organization – this means any money that comes in during an event raising money for the charity must go directly to the charity (no passing “Go”, no shaving operational expenses off the top).

In the second case, as the donations would be collected and deposited directly into the charity, they qualify as charitable donations (tax deductible for the donors, a major plus). This, of course, means that SFJ would have to fund raise separately via T-Shirts, Tip Jars, etc., all of which would not be charitable donations. Any leftover money from that fundraising could be appropriated for future SFJ operational costs, or donated to the charity.

I know. You got to keep records of EVERYTHING. Bank Records, recipes, sales, donations ect…
You don’t need a lawyer per se, but you need a qualified book keeper to keep everything in check.

Hmm, reading this article on the cancelled raffle for a ME3 “Space Edition” bundle, it looks like there’s alot of hurdles this has to clear.

For one, what we did in Vegas last year might actually have been illegal.
