Fishmen/merfolk can eat devil fruit, it just wouldn’t be in their best interest to do so. We’ve already seen Vegapunk figure out how to give inanimate objects devil fruit powers.

I was disappointed when I found out Jinbe wasn’t a Devil Fruit user, but I feel Oda will do it eventually.
