I agree with all of your post, especially the boutiques analog except for this part. As I’ve told you several times before you’re lazily clumping together legal, social, psychological, and economical rights and entitlements. From a legal stand point if someone on kickstarter deviates heavily from their initial pitch and development of said product progresses towards a final producrt which some backers find misleading then thyey may or may not have grounds for a refund the lawyers can sort that out, but there is no one size fits all solution as you claim it is determined on a case by case basis most likely.
From a social and psychological stand point even if we assume that creators on kickstarters are legally entitled to mislead, defraud, and outright lie to consumers and not deliver any product at all after reaching their financial goal the fact is their reputation will most likely be tarnished by the power of word of mouth and should that creator try to make another kickstarter it most likely would cradh and burn, I mean would you buy a product on amazon from a seller with a 1% feedback rating with multiple accounts corroborating that seller as a scam artist? I doubt it.
Economically speaking a kickstarter creator knows when they ask consumers to invest into an unknown product or service their will be an expectation to deliver something that exists between the consumer’s ideal and the creator’s ability to deliver on that realistically whatever those two terms may mean I admit is up for debate which makes it tricky. You continue to say that investing in a kickstarter does not grant a consumer the same rights as say investing in a stock, and in a legal sense you may or may not be correct as mentioned above, but the financial success and “long tail” of that creator’s business is dependent on fulfilling what consumers deem their return on investment should be.
So is a personal beef with a community manager grounds for a refund? the real answer is…maybe. If you get a refund then yes it is grounds and if you don’t then no it’s not.
You lost me once you brought lawyers into this. I’m sure Kickstarter’s terms cover this type of shit in a way that you can’t really get this to appear before a judge. It’s a basic thing to do when you start a business.
Theres mega man 1-2-3-4 that are good. How can you praise that game when it’s aesthetically, musically, and limited as the 8 bit games. It’s a step back because it allows companies to justify half measures, and a cash grab by appealing through nostolgia. I dont know how you of all people approve of that shit. But I don’t blame them, if consumers, even the “hardcore” scene gobbles that shit up, then more power to them.
Because when looked at based on it’s own merits, those games are fun and enjoyable to play for the exact same reasons as the old MM games you listed. Simple as that.
