This shouldn’t suprise us at all. If these accusations were true, than by all means I would encourage Cell Block D type justice on this guy. However, to spend over a decade in jail as an accused child rapist is as bad as it can get. Clearly there needs to be better checks and balances here. This sort of reminded me of this story a couple of years ago where a teacher was falsely accused by a couple of girls:

Same thing happened to my cousin 6 years ago with his psychotic ex-wife and my then 9 yr old cousin, except she claimed molestation not rape.

Someone already mentioned it earlier, but rape cases have a very low rate of reaching prosecution with regard to other crimes. That’s not to say that there aren’t other ways in which women are mollycoddled by a legal system whose values and beliefs are still stuck in Leave It To Beaver land, but this story is atypical for how rape cases usually go down.

Now, let’s examine this failure at every single step.

First off, the woman is Satan. She is a failure of the gene pool, of ethics, of nature, of the human race in general. I have a hard time blaming the daughter, because when you’re that young and your mother (one of the people you’re supposed to implicitly trust above all others) is repeatedly insisting that something is true and threatening to beat you if you disagree, you’re being psychologically reconditioned at an age when you’re most defenseless against it. It’s basically the same brainwashing techniques that religious radicals and authoritarians use on their children–and for them, it usually sticks. It actually reflects favorably upon her that she eventually came to grips with the reality of the situation.

Second off, the cops absolutely failed at their jobs. Cops often fail with regard to rape investigations, but usually the failure occurs when they have substantial evidence but don’t examine it properly and the case never moves forward. This one veers hard in the opposite direction: hammering the case through on the basis of dubious evidence. How did they not instantly smell a rat? I don’t know what the fuck is wrong with these people, but they need to be fired immediately.

The prosecution failed at delivering justice, but we have to expect that, because criminal prosecution is one of the most amoral and bloodthirsty legal fields out there. They succeeded at the job of obtaining a conviction by any means available to them, which is basically the de facto job of criminal prosecutors in this country. The fact that the head prosecutor, in the face of all logic, continues to insist that he was correct is pretty telling. He’s not wrong if you ignore his obligation toward truth and justice and look at things on his terms–his sociopathic, single-minded terms. He did his job.

The judge failed for suddenly placing super-importance on whether or not she was coerced at 15, despite not giving a shit whether or not she might have been coerced at age 9.

There’s not much about the defense here, so I have to assume it was some head-up-his-ass public defender who assumed his own client was guilty and went from there. Fail.

The real absurdity here is that if you take away any one of these pieces, the guy goes free. This collusion of so many fuckups and assholes who are either incompetent or corrupt is pretty uncanny.

The daughter came forward as soon as could be reasonably expected. At 9 it’s no wonder that a little girl wouldn’t have the conviction to stand up to her mother under the threat of physical harm. According to the article the girl told the truth when she was removed from her mother’s custody, and was staying with her grandmother. I really don’t see any point sooner that she could’ve said anything.

When questioned by the police he should’ve chosen from 3 things:

  • “I’d like to exercise my right to remain silent”: Additional point of note: You actually have to state that you’d like to exercise this right see: Berghuis v. Thompkins where it was declared that because the person did not declare this right it did not go into effect.

  • “I do not recall”: This is not the same as “I don’t know.” Saying you don’t recall is non-committal whereas I don’t know is.

  • Don’t answer anything unless you’re charged, and if so ask to have a lawyer present asking for a lawyer seems confrontational, but it’s really the best way means of protection. I know people probably believe “well I haven’t done anything so I’m cool,” but there are lots of cases like this where innocent people get locked up because they say something that makes them come off in a completely different way than they intended.

The truth is doing this will probably drag shit out in the short term, but if you know that you’re being looked at for something major, the less you say the better.

in reality, police are manipulative pieces of shit (partly out of necessity). just think about how confused the average person gets when confronted with some completely mundane, yet untrue shit; generally there’s stuttering, second-guessing, etc… now replace that girlfriend/mom/whoever with a cop and instead of giving you shit over whether or not you drank the oj out of the carton, they’re talking about your jizz on a 9 year old’s panties.

I agree with the latter part of this post but your beginning part is confusing as fuck.

The original post stated that the legal system is catered towards women and you disagreed with this because of the supposed lack of prosecution with rape…yet you freely admitted a bias doest exist later on. I appreciate that you can acknowledge a legal bias in favor of women but what exactly does the lack of prosceution of rape have to do with disproving the original comment.

I know some fools on here might use this as a example because they perceive rape as a crime uniquely against women, but assuming that isn’t the premise your operating under then I’m gonna have to call BS on your first few opening sentences mate. Truth be told is that this situation could only have happened due to the legal advantages women have over men when it comes to rape or assaults of any kind…or at least in this case the mere accusation of one.

He was a Navy vet too… from experience, there’s a lot of bullshit here but… he’d been better off serving 20 for dat lifetime pension if he originally did a 4 year enlistment. Even if he attempts to sue and win millions, to get disturbingly pwned by family for 16 years of your time in jail can’t be paid off.

You said THIS story, when this story actually contradicts the prevailing trends in this particular region of criminal law. Being far from a typical case in the relevant field, I don’t know how you can rightly suggest that it’s indicative of a trend.

There are other stories that very well might suggest biases in favor of women, because there are areas of the legal system that are still stuck in the 1950s–e.g. custody law, which is still under the assumption that women are naturally best at homemaking and childrearing. Those cases may very well go to show a systemic bias in favor of women. This one doesn’t.

Try not to see this case for anything other than what it is: a bizarre freak show, notable mainly for the unlikely and multi-tiered combination of fuckups that enabled it to happen.
